Public agreement (offer) for the use of the services of the website https://www.malginov.com/
Agreement — these Terms of Service governing access to and use of the Site.
Site — the website with domain name https://www.malginov.com/.
Seller / Artist — Konstantin Malginov, operating in accordance with the laws of the United Kingdom. Contact details are listed at the end of this Agreement.
Buyer / Customer — an individual who visits the Site and purchases Goods for personal, non-commercial use.
Order — a completed request submitted by the Buyer for the purchase and delivery of Goods.
Goods — original artworks, including paintings, sculptures, prints, and other artistic items available for sale on the Site.
1.1. By placing an Order on the Site, the Buyer agrees to these Terms of Service, forming a legally binding agreement between the Seller and the Buyer under UK law. If the Buyer does not accept the Terms, they must discontinue use of the Site.
1.2. This Agreement is a public offer in compliance with UK e-commerce regulations, including the Consumer Rights Act 2015, Electronic Commerce (EC Directive) Regulations 2002, and related legislation.
1.3. The Seller may update or amend the Agreement without prior notice. Updated versions are effective immediately upon publication on the Site.
1.4. The Seller may assign or transfer rights and obligations under this Agreement to third parties where legally permitted.
1.5. The Site may be unavailable temporarily due to maintenance or technical issues without prior notice.
1.6. If any clause of the Agreement is deemed invalid or unenforceable, it shall not affect the validity of the remaining provisions.
2.1. The Site offers original artworks for sale. If a selected item is unavailable, the Seller may remove it from the Order and notify the Buyer by email or phone.
2.2. Product descriptions and photographs on the Site provide general information. Images serve as illustrations and may differ slightly from the actual appearance of the Goods.
2.3. The Seller may revise prices at any time. This does not apply to Orders already placed and paid in full.
2.4. Prices for all Goods are listed in GBP (£) and do not include international customs duties, VAT, import taxes or processing fees applicable in the Buyer’s country. Such fees are the Buyer’s responsibility.
3.1. The Buyer may only place Orders for Goods that are in stock and displayed on the Site.
3.2. An Order is placed electronically via the Cart. After reviewing product information, the Buyer selects the Goods, confirms the Order, and provides accurate contact, delivery and payment details.
3.3. The Buyer is responsible for ensuring the accuracy of all information provided. Incorrect or incomplete information may result in delays or inability to process the Order.
3.4. If a pricing adjustment is required, the Seller will contact the Buyer to confirm or cancel the Order. If the Buyer cannot be reached, the Order may be cancelled.
3.5. The Buyer may cancel the Order prior to payment and dispatch.
4.1. All prices are stated in GBP (£).
4.2. Payment systems or banks may apply additional transaction fees. Such fees are borne solely by the Buyer.
4.3. Payment is made by 100% advance payment using the methods offered on the Site.
4.4. The Seller may offer discounts at their own discretion.
5.1. Delivery is carried out via courier or postal services, both within the UK and internationally.
5.2. UK delivery typically takes 3–5 working days, depending on the carrier. International delivery times vary by destination.
5.3. Delivery fees are paid separately by the Buyer according to the carrier’s tariffs unless otherwise specified.
5.4. Upon receipt, the Buyer must inspect the Goods for damage or discrepancies. If issues are found, the Buyer must report them immediately to the delivery service and the Seller. A refusal of Goods due to damage requires an official report with the carrier.
5.5. Ownership of the Goods passes to the Buyer at the moment of delivery and signature of the recipient.
5.6. Delivery is a separate service and is non-refundable unless required by UK consumer law.
5.7. International shipments may be subject to customs clearance procedures, import duties, VAT, or restrictions. These remain the full responsibility of the Buyer.
6.1. Under the Consumer Contracts Regulations 2013, the Buyer has the right to return Goods within 14 days of receiving them, provided the Goods are returned in their original condition.
6.2. Return shipping costs are borne by the Buyer unless the item was damaged on arrival or incorrectly supplied.
7.1. The Seller processes personal data in accordance with UK GDPR and the Data Protection Act 2018.
7.2. Personal data is collected to process Orders, provide customer support, send updates or promotional materials, and improve the Site’s functionality.
7.3. This Privacy Policy applies only to this Site. Third-party platforms have their own privacy rules.
7.4. The Buyer provides their name, surname, email, phone number, and delivery address. Additional information may be given voluntarily.
7.5. The Seller may send promotional emails unless the Buyer opts out.
7.6. The Seller may share personal data with trusted third parties only when necessary to fulfil the Order or comply with legal obligations.
7.7. The Buyer has the right to request access to their personal data, correction, deletion, and restriction of processing. Requests will be answered within 30 days.
